These Terms & Conditions govern the use of the Personiti platform, including our iOS app, Android app, and website.
By creating an account, booking an Experience, or using Personiti, you agree to these Terms.
Personiti operates as a personality-based travel marketplace connecting Travellers with independent Experience Providers through our OCEAN matching system.

By using the Personiti Platform, you agree to these Terms and Conditions. These Terms and Conditions (“Terms”), together with Personiti’s Privacy Policy (available at www.personiti.com/traveller-privacy ), govern your use of the PersonitiPlatform. The Platform includes the Personiti iOS application, Android application, and web platform accessible at www.personiti.com (collectively, the “Platform”). By accessing or using the Platform, downloading the Personiti App, or creating a Traveller Account, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Platform.
These Terms have been drafted, and shall be construed, in the English language. Any translation is for reference only. In the event of inconsistency between the English version and a translated version, the English version prevails.
1. About Us
Personiti FZ-LLC (“Personiti”, “we”, “our”, or “us”) is incorporated in the Dubai Internet City Free Zone, United Arab Emirates. We operate the Personiti Platform, a personality-based travel platform, which connects Travellers to Experiences using the Big Five (OCEAN) personality model.
We operate the Platform as a technology marketplace intermediary through which experience providers, tour operators, activity companies, and individual guides (collectively, “Providers”) offer Experiences including tours, activities, cultural events, workshops, and other travel experiences, for booking by Travellers. We facilitate bookings between you and Providers, but the Experiences themselves are delivered by Providers, not by Personiti.
Personiti is not a travel agent, tour operator, organiser, or activity provider. We do not deliver Experiences ourselves and we are not your contractual partner for the provision of any Experience. The contract for the delivery of each Experience (“Booking Contract”) is formed directly between you and the Provider. Personiti facilitates this Booking Contract as the Provider’s booking facilitator.
Personiti and the Personiti Parties (as defined below) are not responsible or liable for any acts, errors, omissions, representations, warranties, negligence, or misconduct of Providers, nor for any personal injury, death, property damage, or other loss arising from Bookings or the delivery of Experiences.
2. Scope
2.1 These Terms apply to all visitors and users (“Travellers” or “you”) of the Platform, including anyone who registers for a Traveller Account, browses Experiences, makes Bookings, or uses any feature of the Platform. From the moment you access any part of the Platform, you are bound by these Terms.
2.2 These Terms apply to all of Personiti’s services unless more specific terms apply to a particular service or feature, in which case we will clearly inform you. Any other terms not included here, or that conflict with these Terms, will not apply unless we have expressly agreed to them in writing.
2.3 The Platform is available to Travellers worldwide, subject to applicable local laws and Stripe’s payment availability in your country. Where local mandatory consumer protection law in your country of residence provides rights that are more favourable to you than these Terms, those mandatory rights apply in addition to these Terms.
3. What We Do
3.1 When you book an Experience, the Booking Contract for that Experience is concluded directly between you and the Provider. You are not purchasing the Experience from Personiti; you are purchasing it directly from the Provider. Personitifacilitates the booking transaction on behalf of the Provider and is authorised by the Provider to: (i) facilitate the conclusion of the Booking Contract between you and the Provider; and (ii) enable payment processing through the Provider’s Stripe Connected Account. Personiti does not itself offer Experiences and does not become your contractual partner for the delivery of any Experience.
3.2 Personiti receives a platform application fee (Commission) from the Provider for each Booking facilitated through the Platform. The price displayed to you on the Platform (the “Posted Price”) or the amount you pay at checkout (the “Booking Price”) may include a Personiti Service Fee charged by Personiti to you in addition to the Provider’s price. The Personiti Service Fee is disclosed at checkout before you confirm a Booking.
3.3 The OCEAN identity layer. When you complete the Big Five (OCEAN) personality assessment during registration, Personiti generates your personality profile. This profile represents your personality preferences within the Platform and remains stable unless you choose to retake the assessment. Each Experience on the Platform carries its own OCEAN compatibility profile, generated during the listing approval process. Personiti uses the match between your OCEAN profile and each Experience’s profile to determine psychographic compatibility.
3.4 The filter layer. When searching for Experiences, you apply session-specific filters including destination, travel dates, budget range, group size, and interest categories. These filters are dynamic: they change with every search and reflect what you are looking for on a specific trip. Filters narrow the pool of available Experiences to those that are practically relevant. Your OCEAN compatibility score then ranks the filtered results by personality compatibility, so you see Experiences that match both your trip and your personality.
3.5 Your OCEAN profile is also used to surface fellow Travellers with potentially compatible personality preferences where you opt in to the social discovery feature. Experience ranking reflects a combination of OCEAN match score, Provider performance metrics, and other factors designed to improve your experience on the Platform.
3.6 All Experience information on the Platform, including descriptions, photographs, pricing, and availability, is provided and maintained by the respective Providers. Each Provider is responsible for ensuring their content is accurate. Personitireviews Experience Listings before they are published but does not guarantee the accuracy or completeness of Provider-provided content.
3.7 Personiti reserves the right to impose conditions on your use of the Platform, including restricting access to certain features, based on factors such as payment history, identity verification status, or suspected violations of these Terms. If Personiti suspects fraud or misuse, it may restrict or cancel your Bookings.
3.8 Personiti is not obligated to continue to operate the Platform or any particular feature indefinitely. We may discontinue, modify, or limit features at any time. Where you have already made a confirmed Booking, the Booking Contract with the Provider remains in effect.
4. Traveller Account
4.1 To access all features of the Platform, including making Bookings, you must register for a Traveller Account. To register, you must provide your full legal name, email address, and create a password. You may alternatively register using an existing social media or digital account (such as Apple, Google, or similar), subject to that provider’s own terms.
4.2 You must be at least eighteen (18) years of age to create a Traveller Account and make Bookings. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract under the laws of your jurisdiction.
4.3 You are responsible for maintaining the confidentiality of your account credentials and must not share them with any third party. You are responsible and liable for all activities conducted through your Traveller Account. You must immediately notify Personiti at hello@personiti.com if you suspect that your credentials have been compromised or that your account has been accessed without your authorisation.
4.4 You may only create one Traveller Account for yourself. You may not transfer your Traveller Account to any other person.
4.5 The information you provide during registration must be accurate and complete, and you must update it promptly in the event of any change. Providing false information may result in suspension or termination of your account.
5. The OCEAN Personality Assessment
5.1 As part of the Personiti onboarding experience, you will be invited to complete a Big Five (OCEAN) personality assessment. Completion of the assessment is optional for basic Platform access but is required to receive OCEAN-based Experience matching, social discovery features, and a Traveller profile. By completing the assessment, you consent to the generation and use of your OCEAN profile for the purposes described in these Terms and in Personiti’s Privacy Policy, including display on your Traveller profile and sharing at your discretion.
5.2 Your OCEAN profile contains personality profile data used to personalise travel matching and related Platform features. Personiti applies enhanced privacy protections to OCEAN profile data and processes it in accordance with applicable data protection law, including UAE Federal Law No. 45 of 2021 on Personal Data Protection (PDPL) and, where applicable, the EU GDPR. Full details are set out in Personiti’s Privacy Policy at www.personiti.com/privacy.
5.3 Your OCEAN profile is used by Personiti for the following purposes:
5.3A Matching Disclaimer
Personiti’s personality-based matching system is designed to provide indicative compatibility recommendations only. Compatibility scores and recommendations do not guarantee satisfaction, interpersonal compatibility, emotional outcomes, or the suitability of a particular Experience.
5.4 Profile Visibility Settings. Your Traveller profile — including your OCEAN dimension scores — can be set to Private or Public within the Personiti App. The default setting is Private. You must actively choose to make your profile Public.
Public profiles and visibility. Setting your profile to Public means you are voluntarily disclosing personal profile information to other Platform users and Providers. Personiti strongly recommends reviewing your privacy settings carefully before making your profile Public. You may change your visibility setting at any time in the App. Changing from Public to Private does not erase historical visibility but prevents further access from the point of change.
Personiti cannot control how other users may interpret, reproduce, share, or otherwise use information that you voluntarily choose to make public through your profile settings.
5.5 Sharing. You may also share your OCEAN profile directly with specific individuals — Travellers or others — using the share function within the App. Shared profiles can be viewed by anyone with whom you share a profile link. Personiti is not responsible for how recipients use OCEAN profile information you have voluntarily shared outside the Platform.
5.6 What your OCEAN profile is not used for. Regardless of your visibility setting, your OCEAN Data is not used for advertising, commercial profiling, insurance underwriting, credit assessment, employment screening, or any purpose other than travel matching and profile display as described in this Section. Providers who can view your public profile may not use that information for any purpose beyond understanding Experience compatibility.
5.7 Your OCEAN profile is stable by design. It does not change automatically based on your search activity, filter selections, or booking history. It only changes if you actively choose to retake the assessment. This means your personality profilereflects a considered snapshot of your personality, not your browsing behaviour.
5.8 You may retake the OCEAN assessment at any time through your account settings. Each retake replaces your previous profile. You may withdraw your consent to OCEAN profiling at any time by contacting privacy@personiti.com, though withdrawal will disable personality-based matching features, social discovery, and your Traveller profile. Withdrawing consent does not affect the lawfulness of processing that occurred before withdrawal.
Your OCEAN profile does not determine your worth or capabilities. The Big Five model describes personality tendencies on a spectrum; it is not a fixed label. Your profile is one input into Experience matching and is not used for any discriminatory, predictive, or evaluative purpose beyond the travel matching features described in these Terms.
6. The Personiti App
6.1 Personiti provides iOS and Android mobile applications (“Personiti App” or “App”). Subject to these Terms, Personiti grants you a non-exclusive, revocable, non-transferable, non-sublicensable, limited licence to download, install, and use the App solely: (i) for your personal, non-commercial use; and (ii) in accordance with these Terms and the terms of the relevant app store (Apple App Store or Google Play Store). All rights not expressly granted to you are reserved by Personitiand its licensors.
6.2 You may not: copy, modify, adapt, or create derivative works of the App; redistribute or sublicense the App; reverse-engineer, disassemble, or attempt to derive the source code of the App, except where such restriction is expressly prohibited by applicable law; or use the App for any commercial or professional purpose.
6.3 If you sell or transfer your mobile device, you must remove the App from the device before doing so.
6.4 Personiti may, from time to time, develop and provide updates to the App, including bug fixes, patches, new features, or modifications that may change or remove existing features (“Updates”). Personiti has no obligation to provide any particular Update or to continue to make any particular feature available. Depending on your device settings, Updates may be downloaded and installed automatically. You must promptly install all Updates. The App or certain features may not function correctly if you fail to do so. All Updates are part of the App and subject to these Terms.
6.5 When you download, install, or use the App, Personiti may use automatic means (including cookies, SDKs, and analytics tools) to collect information about your mobile device, your location (where you grant permission), and your use of the App. All information collected through the App is subject to Personiti’s Privacy Policy at www.personiti.com/privacy.
6.6 The App is available through the Apple App Store and Google Play Store. Your use of the App is also subject to the applicable app store’s terms of service. In the event of conflict between these Terms and the app store’s terms, these Terms govern the relationship between you and Personiti.
7. Bookings
7.1 How Booking Works
When you select and book an Experience on the Platform, your Booking is confirmed instantly and automatically. There is no waiting period or manual approval step from the Provider. The Booking Contract is formed between you and the Provider at the moment you complete your Booking. The process operates as follows:

You choose an Experience, date, time, and number of participants and proceed to checkout.
2. You confirm
You review the Booking details, the total price, and any cancellation conditions, and confirm your Booking.
3. Instant confirmation
Your payment is captured immediately. Your Booking is confirmed instantly. You receive a Booking confirmation by email and in the App. The Booking Contract is formed between you and the Provider at this moment.
4. Provider notified
The Provider receives a Booking notification by email and in their Provider Dashboard simultaneously. The Provider is expected to have kept their availability accurate; the Booking is a binding commitment on the Provider from this point.
7.2 Once you receive a Booking confirmation, the Booking Contract is formed. You must immediately check the confirmation to ensure all details are correct. If you identify any error, contact hello@personiti.com promptly.
7.3 For some Experiences, the Provider may require you to accept their own terms and conditions as part of the booking process. Where this is the case, you will be prompted to review these before completing your Booking. Please read any Provider-specific terms carefully as they may contain important information about cancellation conditions, health and safety requirements, and participation conditions.
7.4 By completing a Booking, you confirm that: (i) the information you have provided is accurate and complete; (ii) you meet any participation requirements specified in the Experience Listing; and (iii) you are making the Booking for yourself and any co-participants you have included, and you accept these Terms on their behalf.
7.5 Booking Modifications. Subject to Experience availability, Personiti may, on your request, change the date, time, or number of participants for a confirmed Booking up to two (2) hours after the Booking was made, at no additional charge. Modification requests must be submitted through the Platform. After the two-hour window, modifications are subject to the cancellation policy in Section 9.
7.6 Experience Vouchers and Confirmation
On confirmation of a Booking, Personiti will provide you with a Booking confirmation and, where applicable, a digital voucher or ticket (via the App or email). You must present this confirmation to the Provider at the start of the Experience. Providers are required to accept Booking confirmations displayed on your mobile device. Personiti is not responsible for any failure to deliver the Experience caused by your failure to present a valid Booking confirmation.
7.7 Provider Broadcast Notifications
Providers may send operational push notifications to all Travellers who hold a confirmed Booking for a specific Experience slot, using Personiti’s Provider Dashboard. These notifications are delivered by Personiti on the Provider’s behalf and may include last-minute changes to the Experience, meeting point updates, cancellation notices, or essential logistics information. You will receive such notifications through the Personiti App if you have enabled push notifications.
Providers are not permitted to use this broadcast tool for marketing, promotional content, off-platform solicitation, or any purpose other than operational updates related to your confirmed Booking. If you receive a push notification from Personition behalf of a Provider that appears to violate this restriction, please report it to hello@personiti.com.
8. Payment
8.1 The Booking Price is the Posted Price minus any applicable discounts or promotional offers, plus any applicable Personiti Service Fee. The Booking Price displayed at checkout is the total amount you will pay. Payment is captured immediately when you confirm your Booking.
8.2 All payments are processed by Stripe through the Provider’s Stripe Connected Account. Payments are processed through Stripe Connect infrastructure on behalf of Providers.
By completing a payment, you fulfil your payment obligation to the Provider. Stripe’s terms of service apply to payment processing.
8.3 The Platform supports 135+ currencies via Stripe Checkout. You may pay in your local currency where supported. Where currency conversion is required, Stripe applies its exchange rate at the time of payment capture. Personiti is not liable for any difference between Stripe’s exchange rate and any published or interbank rate.
8.4 You must provide payment information truthfully and update it promptly in the event of any change. By submitting payment details, you confirm that you are authorised to use the payment method you have provided. Personiti reserves the right to restrict access to payment functions if fraudulent or unauthorised payment activity is suspected.
8.5 Personiti Service Fee. In addition to the Provider’s Retail Price, Personiti charges a Personiti Service Fee to process your Booking. The amount of the Personiti Service Fee is displayed at checkout before you confirm your Booking. To the fullest extent permitted by applicable law, the Personiti Service Fee is non-refundable except where the cancellation results from a Provider-initiated cancellation, a confirmed Force Majeure Event, or where mandatory consumer protection law requires otherwise.
8.6 Taxes. Posted Prices are displayed inclusive of applicable taxes where required by law in the relevant jurisdiction. Where additional local taxes or fees are levied at the Experience location, this will be disclosed in the Experience Listing. You are responsible for any taxes applicable to your purchase under the laws of your jurisdiction.
Payment security. Personiti uses Stripe for all payment processing. Stripe is PCI DSS compliant. Personiti never stores your full card details and has no access to your payment card data. For any payment dispute, contact hello@personiti.com.
9. Cancellations and Refunds
9.1 All cancellations and refund requests must be submitted through the Platform via the App or at www.personiti.com. Do not attempt to cancel directly with the Provider. The decisive moment for a cancellation is when Personiti receives your notification through the Platform.
9.2 Standard Cancellation Policy. The following policy applies to all Bookings made through the Platform:
More than 24 hours before the Experience start time
Full refund of the Booking Price (excluding Personiti Service Fee)
24 hours or less before the Experience start time
No refund
No-show (failure to attend without cancelling)
No refund
9.3 The cancellation window is calculated from the confirmed Experience start time. The decisive moment for a cancellation is when Personiti receives your cancellation request through the Platform.
9.4 Provider-Initiated Cancellations. If a Provider cancels a confirmed Booking, Personiti will notify you promptly and issue a full refund of the Booking Price, including the Personiti Service Fee. Where possible, Personiti will offer you alternative OCEAN-matched Experiences of equal or better quality.
9.5 Force Majeure. If an Experience cannot proceed due to a Force Majeure Event — including natural disasters, war, armed conflict, government travel restrictions, epidemic, or pandemic — Personiti will, at your election, either: (i) issue a full refund of the Booking Price; or (ii) provide a rescheduling credit of equal value, redeemable against any future Booking on the Platform. Any rescheduling credit issued under this Section is valid for twelve (12) months from the date of issue unless otherwise required by applicable law.
9.6 Extenuating Circumstances. Personiti may, acting reasonably, issue a full or partial refund outside of the standard cancellation policy where you can demonstrate that exceptional and unforeseen personal circumstances (such as serious illness, bereavement, or significant travel disruption) made it impossible to attend the Experience. Evidence may be required. Personiti’s determination is final.
9.7 Statutory Consumer Rights. This cancellation policy applies to the fullest extent permitted by applicable law. Where mandatory consumer protection legislation in your jurisdiction provides cancellation or refund rights that are more favourable to you than this policy, those statutory rights apply. In particular, EU consumers may have statutory withdrawal rights under the Consumer Rights Directive 2011/83/EU for certain types of contracts. Note that under Article 16(l) of the Consumer Rights Directive, the right of withdrawal does not apply to contracts for leisure activities when the contract specifies a particular date or period of performance; this exclusion applies to date-specific Experience Bookings.
9.8 Refunds will be issued to the original payment method used for the Booking. Refund processing times vary by payment method and financial institution; Personiti will instruct Stripe to process the refund promptly following a valid cancellation, but Personiti is not responsible for any delay caused by your bank or card issuer.
10. Attending an Experience
10.1 You must arrive on time at the meeting point specified in the Experience Listing or as communicated directly by the Provider before the Experience begins. Personiti is not responsible for your failure to attend due to lateness or failure to read Booking instructions.
10.2 If you are travelling internationally to attend an Experience, you are solely responsible for obtaining the necessary travel documents (passport, visa, relevant permits) and for complying with all applicable health and entry requirements of the destination country.
10.3 The Booking Price does not include insurance of any kind. You are responsible for obtaining appropriate travel insurance. Personiti strongly encourages you to obtain travel insurance, particularly for Experiences with outdoor or physical activity elements.
10.4 Providers reserve the right to exclude you from an Experience if: (i) you do not meet the participation requirements specified in the Experience Listing; (ii) your participation would endanger yourself or others; or (iii) your behaviour disrupts the Experience for other participants. In such cases, no refund will be issued.
10.5 Providers may make immaterial changes to the Experience itinerary at any time if required by unforeseen circumstances. This may include a change to the meeting point, provided the new location is accessible from the original meeting point within fifteen (15) minutes on foot or by public transport. Changes will be communicated to you by email or through the Platform. Operational updates communicated directly by the Provider regarding meeting points, timing, or logisticsprevail in the event of inconsistency with previously published operational details on the Platform.
10.6 Time and deadline calculations are based on the time zone of the location where the Experience takes place, unless otherwise stated.
11. Prohibited Conduct
When using the Platform, you must not:
Personiti reserves the right to take any action it deems necessary in response to violations of this Section, including restricting or terminating your access to the Platform, cancelling Bookings, and pursuing legal remedies.
12. Reviews
12.1 Verified Reviews Only
After a confirmed Booking has been completed and the Experience has taken place, you will be invited to submit a review and rating of that Experience. Reviews on Personiti are verified-only: only Travellers who have completed a confirmed Booking for the specific Experience may leave a review. This verification is automatic and enforced by the Platform. Unverified, third-party, or speculative reviews are not permitted and will be removed.
Reviews are attributed to your Traveller Account and displayed alongside your first name. Personiti does not offer an anonymous review option. Where your Traveller profile is set to Public, a link to your profile may also be displayed alongside your review. You are fully responsible for all review content you submit.
12.2 The Fit for You Score
Every verified review is displayed alongside a Fit for You score. This is Personiti’s OCEAN compatibility rating between your personality profile and the Experience’s profile, calculated at the time of your Booking. It is a single compatibility indicator derived from the matching engine, it does not display your individual OCEAN dimension scores. The Fit for You score is an indicative compatibility signal only and should not be interpreted as a guarantee of Traveller satisfaction or Experience quality.
The Fit for You score provides honest context for other Travellers reading the review:
The Fit for You score and your OCEAN Data. The Fit for You score is derived from your OCEAN profile but does not directly disclose your individual OCEAN dimension scores. It is a compatibility indicator. By submitting a review, you consent to the display of your Fit for You score alongside your review on the Experience Listing. Full details of how Personiti processes your OCEAN Data in connection with reviews are set out in the Privacy Policy at www.personiti.com/privacy.
12.3 What You May and May Not Submit
Reviews must reflect your genuine, personal experience of the specific Experience you booked and attended. You must not submit review content that:
12.4 Photographs
You may submit photographs taken during the Experience alongside your review. Photographs may only contain other identifiable persons if those persons have consented to their inclusion. By uploading a photograph you confirm that you hold the rights to the image and that any identifiable persons depicted have given their consent.
12.5 Licence to Use Review Content
You retain ownership of any review content you create. By submitting a review, you grant Personiti a non-exclusive, sublicensable, worldwide, fully paid, royalty-free licence, in all media now known or later developed, to use, reproduce, adapt, translate, create derivative works of, modify, publicly display, transmit, and distribute the review content: (i) on or through the Platform; (ii) through Personiti’s distribution channels; and (iii) in online and offline marketing materials. This licenceincludes the right to display the Fit for You score alongside your review as described in Section 12.2. You are not entitled to any compensation for your review content.
12.6 Review Deletion and Moderation
You may request deletion of a review you have submitted at any time by contacting privacy@personiti.com. Personiti will remove the review and associated Fit for You score from public display within ten (10) Business Days of receiving a valid request. Personiti may also remove review content at its sole discretion where it violates this Section or Personiti’s content policies. Personiti will not remove a review solely because it is negative or unflattering to the Provider. Accurate reviews reflecting a Traveller’s genuine experience are a core and protected feature of the Platform. Personiti reserves the right to investigate suspicious review activity, including coordinated manipulation, fraudulent reviews, or attempts to artificially influence compatibility perception on the Platform.

In our role as booking facilitator, Personiti provides customer service support for Bookings made through the Platform. If you have a question, complaint, or need assistance, you can contact Personiti at:

We aim to respond to all enquiries within twenty-four (24) hours and will respond within forty-eight (48) hours in all cases. In an emergency, the contact details for your Provider are included on your Booking confirmation.
14. Intellectual Property
14.1 The Platform and all content on it, including the Personiti brand, OCEAN matching algorithm, personality matching framework, software, design, text, images, and trade marks (collectively, “Personiti Content”) are owned by Personiti or its licensors. Personiti Content is protected by applicable intellectual property law.
14.2 You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform and Personiti Content solely for your personal, non-commercial use in connection with booking and attending Experiences.
14.3 You may not copy, modify, distribute, publicly display, transmit, reproduce, publish, licence, create derivative works from, transfer, or sell any Personiti Content without Personiti’s prior written consent.
14.4 All Personiti trade marks, service marks, logos, and brand names displayed on the Platform are the property of Personiti or its licensors. You may not use any Personiti trade mark without Personiti’s prior written permission.
15. Data Protection
Personiti processes your personal data, including personality profile data generated through the OCEAN assessment, in accordance with UAE Federal Law No. 45 of 2021 on Personal Data Protection (PDPL) and, where applicable, the EU GDPR. For detailed information on what data we collect, why we collect it, how we use it, your rights, and how to contact us about your data, please refer to Personiti’s Privacy Policy at www.personiti.com/privacy. By using the Platform and completing the OCEAN assessment, you consent to the processing of your personal data as described in the Privacy Policy.
16. Liability
16.1 Personiti’s Role
Personiti is a technology marketplace intermediary. We facilitate bookings between Travellers and Providers but are not the provider of any Experience. Providers are independent contractors and are not agents, employees, or representatives of Personiti. Personiti is not responsible or liable for any act, error, omission, representation, warranty, breach, negligence, or misconduct by any Provider, or for any personal injury, death, property damage, or other loss arising from or related to any Experience.
16.2 Limitation of Liability
To the fullest extent permitted by applicable law, Personiti’s total aggregate liability to you arising out of or in connection with these Terms or your use of the Platform shall be limited to the greater of: (i) the Booking Price paid by you for the specific Experience giving rise to the claim; or (ii) USD 500 (or the equivalent in your local currency).
Personiti is not liable for any indirect, special, incidental, consequential, exemplary, or punitive damages, including loss of profits, loss of revenue, loss of data, or costs of procurement of substitute services, arising from or in connection with your use of the Platform, your Bookings, or your participation in any Experience, regardless of whether Personiti was advised of the possibility of such damages.
16.3 No Liability for Provider Acts
To the fullest extent permitted by applicable law, Personiti is not liable to you for acts or omissions of any Provider, including the failure to deliver an Experience as described, cancellation of a confirmed Booking, changes to an Experience itinerary, or any injury, loss, or damage occurring during or in connection with an Experience.
16.4 No Warranty
The Platform is provided “as is” and “as available” without warranties of any kind, express or implied. Personiti does not warrant that: (i) the Platform will be uninterrupted, error-free, or secure; (ii) Experience Listings will be accurate or complete; or (iii) the Platform will meet your requirements. Personiti does not guarantee that you will find Experiences compatible with your OCEAN profile, or that personality-matched Experiences will result in any particular outcome.Personiti periodically reviews and refines its matching systems to support fairness, relevance, and appropriate functionality.
16.5 Mandatory Consumer Rights
Nothing in these Terms excludes or limits Personiti’s liability for: (i) death or personal injury caused by Personiti’s negligence; (ii) fraud or fraudulent misrepresentation; or (iii) any other liability that cannot be excluded or limited under applicable law. Where mandatory consumer protection law in your jurisdiction provides rights that are more favourable to you than these Terms, those rights apply.
17. Indemnification
You agree to indemnify, defend, and hold harmless Personiti FZ-LLC and its officers, directors, employees, agents, affiliates, successors, and assigns (“Personiti Parties”) from and against any and all claims, liabilities, damages, fines, penalties, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
This indemnification obligation applies only to the extent that the relevant claim, loss, or liability was directly caused by your intentional or negligent act, omission, or breach of these Terms.
18. Termination
18.1 You may close your Traveller Account at any time by contacting hello@personiti.com or using the account deletion function in the App or your account settings. Closing your account does not cancel any confirmed Bookings; the cancellation policy in Section 9 applies.
18.2 Personiti may suspend or terminate your Traveller Account or your access to the Platform at any time, with notice where practicable, for reasons including: your breach of these Terms; suspected fraud or misuse; failure to provide accurate registration information; or at Personiti’s reasonable discretion for other legitimate operational reasons. Where you have confirmed Bookings, Personiti will use reasonable endeavours to honour those Bookings or arrange appropriate refunds.
18.3 Personiti may terminate these Terms and your access to the Platform at any time with one (1) week’s written notice. Such termination becomes effective only after any existing confirmed Bookings have been fulfilled or cancelled. The right to terminate for good cause (immediately) is not affected.
18.4 Upon termination of your account, your right to use the Platform and App ceases. Personiti will handle your personal data following account closure in accordance with its Privacy Policy.
19. Changes to These Terms
Personiti may update these Terms from time to time to reflect changes in law, Platform functionality, or Personiti’s business practices. Where we make material changes, we will notify you by email to your registered account address and by in-app notification at least thirty (30) days before the change takes effect. For changes required urgently by law or regulation, a shorter notice period may apply. Your continued use of the Platform following the effective date of updated Terms constitutes your acceptance. If you do not accept a material change, you may close your account in accordance with Section 18.
20. Governing Law and Dispute Resolution
20.1 These Terms are governed by and construed in accordance with the laws of the United Arab Emirates as applied in the Emirate of Dubai, including applicable UAE Federal legislation and Dubai Emirate law.
20.2 Good Faith Negotiation. In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform (“Dispute”), you and Personiti agree to first attempt to resolve the Dispute through good faith negotiation. You may contact Personiti at hello@personiti.com. We will endeavour to respond within twenty (20) Business Days. If the Dispute cannot be resolved within thirty (30) calendar days, either party may submit the Dispute to mediation.
20.3 Mediation. If the Dispute cannot be resolved through negotiation, either party may submit the Dispute to non-binding mediation administered by the Dubai International Arbitration Centre (DIAC). Costs of mediation are shared equally.
20.4 Arbitration. If the Dispute cannot be resolved through mediation, it shall be finally resolved by binding arbitration administered by DIAC under the DIAC Arbitration Rules in force at the time of referral. The arbitration shall be: (i) conducted by a sole arbitrator appointed in accordance with the DIAC Rules; (ii) conducted in the English language; (iii) seated in Dubai, UAE; and (iv) confidential. DIAC arbitration awards are enforceable pursuant to the United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York Convention, 1958). Nothing in this Section prevents either party from seeking urgent injunctive or other interim relief from a court of competent jurisdiction where necessary to prevent serious harm.
Online Dispute Resolution (EU Travellers). If you are based in the European Union, you may use the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/ for disputes relating to online purchases. 20.5 Mandatory local law. Where mandatory consumer protection legislation in your jurisdiction provides dispute resolution rights that are more favourable to you, those rights apply in addition to this Section.
21. General Provisions
21.1 Assignment. You may not transfer or assign your rights or obligations under these Terms to any third party without Personiti’s prior written consent.
21.2 Severability. If any provision of these Terms is held invalid, illegal, or unenforceable by a court of competent jurisdiction, the validity and enforceability of the remaining provisions will not be affected. The invalid provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible.
21.3 Waiver. Personiti’s failure or delay in enforcing any provision of these Terms does not constitute a waiver of that provision or any other provision.
21.4 Entire Agreement. These Terms, together with Personiti’s Privacy Policy, constitute the entire agreement between you and Personiti with respect to your use of the Platform and supersede all prior or contemporaneous communications and agreements.
21.5 Notices. All notices under these Terms must be in writing. Personiti will send notices to your registered email address. You may send notices to Personiti at hello@personiti.com.
21.6 Relationship. You and Personiti are independent parties. These Terms do not create any employment, partnership, joint venture, or agency relationship.
21.7 Interpretation. In these Terms: (i) “including” means “including but not limited to”; (ii) headings are for convenience only; (iii) words suggesting the singular include the plural and vice versa.
21.8 Injunctive Relief. You acknowledge that a breach by you of Sections 11 (Prohibited Conduct), 12 (Reviews), or 14 (Intellectual Property) may cause serious harm to Personiti for which monetary damages would be inadequate. Personiti is entitled to seek injunctive or other equitable relief in any court of competent jurisdiction without posting a bond or proving actual damages.
21.9 UN Convention Exclusion. The provisions of the United Nations Convention on Contracts for the International Sale of Goods do not apply to these Terms.
21.10 Platform Availability. Personiti does not guarantee uninterrupted availability of the Platform, App, matching functionality, or any specific feature. Access may be suspended temporarily for maintenance, updates, technical issues, or operational reasons.
